All Law Students to be Promoted: BCI

Issuing fresh guidelines for law exams and the promotion of law students amid the COVID-19 crisis, the Bar Council of India (BCI) has said that all law students apart from those in the final year shall be promoted. The same shall be based on the marks obtained in the internal exam of the current year and previous years.

The BCI also added that after reopening of colleges and universities, institutions may hold the end semester examination within a reasonable period of time. This shall be with reference to the year from which the students have been promoted. However, the promoted students shall keep studying in the year to which they have been promoted.

In case students do not pass or clear any paper of such end semester exam conducted by institutions, they will be required to clear it before they are awarded the degree. The students who have been promoted to the final year of LLB will be granted their degree only if they pass all the papers.

The BCI has permitted the final year students of three and five-year LLB programmes to take exams in online mode. All those final year students who could not clear all previous year papers and need to take the supplementary exam but have also been promoted to the final year shall be permitted to appear in online exam or write a project report with regard to supplementary or pending papers. The same will ensure that they pass within time.

The lawyers’ body further clarified that the universities can adopt any other method to conduct the examination for the final year LLB students. Under this system, the students may have to write a project report or a research paper for each final year paper. They may also introduce an infallible method for the semester exams already conducted for such year in order to double the students’ internal marks.

The BCI insisted that universities abide by the COVID-19 protocol and ensure that the health and safety of students are not compromised. Universities must maintain the highest standards while conducting the exams.
