Madras HC Asks Medical Student to Seek Varsity's Permission to Write Examinations

The High Court of Tamil Nadu directed a medical student who involved in torturing and killing a monkey to seek permission of Dr. MGR Medical University to write the final year semester examinations which are going to commence from February 1, 2017. For this purpose, the High Court sent a recommendation to varsity. The varsity may consider or may not consider the recommendation of the High Court depending upon the student's involvement in crime at the stage of FIR.

Justice B. Rajendra passed a directive to varsity to allow student for the final year semester examinations. The petition was filed by Arun Louis Sasikumar, a final year student of Christan Medical College (CMC), Vellore. Earlier, a case was filed against four students of CMC who also include Arun for allegedly torturing and killing a monkey. They were booked under Wildlife Protection Act 1972. A social activist filed the complaint. However, Arun obtained anticipatory bail in the month of December.

These students were suspended by the college for torturing, killing and burying the monkey on the campus.

The court directed the varsity to give a representation by January 6, 2017, whether the student is allowed to write the examination or not. The court mentioned that as per Mandamus (writ petition), the court has the authority only to make representation to the varsity and the varsity considers the same independently and disposes the same within one week. The varsity will not take the last date of fee payment while considering the representation.
