The Delhi High Court has said thatstudents are compelled tostudy MBBS abroaddue to the lack of adequate medical institutions in India offering affordable and quality education.This has become the centre of concern amid theoverwhelming numbers ofstudents rescued from war-torn Ukraineand them losing their seats in medical colleges.
The recent situation of thousands of Indian studentsstranded in Ukraine amidthe war between the two countries has pushed Indian authorities to ponder over the reasons why so many Indian students studyabroad. The discussion took the centre stage as the news of several stranded Indian students being from the medical stream came to light.
While granting permission to Santosh Medical College, managed by Santosh Trust (previously Maharaji Educational Trust), to increase seats in undergraduate and postgraduate courses, the adjudicating Justice Rekha Palli stated the observation as a part of her 41-page judgement.
Her statement observed the problem that many students are forced to opt for foreign medical education due toan inadequate number of medical colleges in India that can offerquality and affordable medical education. This, as per her statement, has caused a large number of students to now lose their seats in medical colleges amid the Ukraine-Russia crisis.

A petition was filed by the trust against the disapproval letters issued by the National Medical Commission (NMC) on request of increase in number of seats in UG (MBBS) and PG (MS) courses of Obstetrics & Gynaecology and Orthopaedics. The NMC has also directed an interim inspection of the college for continuation of existing recognition for 100 MBBS seats.
The judgement granted the college permission to participate in further rounds of counselling, increased the number of seats petitioned, and revoked the orders of inspection upon the college.
The courts set aside two orders on grounds that college has already missed two counselling sessions, and the delay would prevent it from participating in upcoming Mop-Up and Online Stray Vacancy rounds of counselling.

The court stated that the present ratio of medical professionals to population is low and needs to be made better, which makes the request of increase in seats in MBBS (100 to 150), MS Obstetrics & Gynaecology to (4 to 7) and MS Orthopaedics (3 to 7), significant. Moreover, the college has been in existence for over 20 years and is equipped in infrastructure to handle the pressure of seat increase.
The court observed that irrespective of the petitions stand being correct the fact remains that, even after running the institute for 28 years the expectations of the younger generation are not being satisfied.
