NEET PG 2022 Admissions: SC to hear Pleas On EWS Criteria in July For Final Hearing

NEET PG Admissions for EWS Quota is fixed at INR 8 Lakhs which was pleaded at the Supreme Court. On the hearing on May 19, 2022, the three-judge bench, Justice Surya Kant, Justice PS Narasimha, and Justice DY Chandrachud said they will hear the plea after the summer vacation in July. The Apex Court is going on summer vacation from May 23rd to July 10th 2022. The matter requires a three-judge bench which is only possible in July after the summer vacation and reopening of the court.

NEET Aspirants are represented by a Senior Advocate, Arvind Datar, who challenges the applicability of the determination of the EWS section, which is fixed at an Annual Income of INR 8 lakhs. He says that the government has lifted the criteria of INR 8 lakhs income fixed for the creamy layer in OBC is adopted for the EWS as well. And with the NEET PG 2022-23 exams right around the corner, the matter should be discussed and a remedy should be provided. 

Further, the Senior Advocate adds to his statement that there has already been a huge disparity in the per capita income, and the appellant has made its plea and submitted a written affidavit as well. All that is awaited is the final decision. 

On February 14, 2022, the Supreme Court of India refused the plea for the applicability of the EWS criteria of INR 8 lakh in NEET PG 2022-23. The Court said that it would decide the criteria and will implement them, which must be followed. The court disclosed that the matter will be heard, a firm decision will be made, and no unnecessary delays were being made. The SC reassures that it will make a decision, and it must prevail. 

Previously on January 20, 2022, the SC had said that SC is not responsible to decide the performance of the candidates and then the reservations. The reservation for the OBC will stand at 27% and that for the EWS will stand at 10%. The court also adds that midst of the ongoing pandemic, the country requires its doctors, and merely stalling or delaying will cause panic. The court instructed the authorities to proceed with the prevailing reservation through the All India Quota (AIQ) system and appoint doctors after the 2021 counselling process.

The bench of the SC on January 7, 2022, said that it was an urgent need to start with the counselling process for NEET PG 2021 and referred to the report submitted by the three-member committee. This committee consisted of Sanjeev Sanyal, Principal Economic Adviser to the Centre; Ajay Bhushan Pandey, former finance secretary; and VK Malhotra, member secretary, ICSSR. The committee was in charge of research and submitted its report on December 31, 2021. The report concluded that an annual family income of INR 8 lakhs is enough for EWS reservations in the current scenario. The report also states that INR 8 lakhs is the threshold of annual family income and is reasonable for the purpose.
