Supreme Court Cancels Maharashtra's Notification on EWS Quota in PG Medical Courses

The Supreme Court has cancelled the Maharashtra government’s notification regarding the grant of 10 per cent quota in admissions for the academic year 2019-20 to postgraduate medical courses for students under the EWS Quota.

Ranjan Gogoi, the Vacation bench of Chief Justice in India and Justice Aniruddha Bose nixed the notification stating that the EWS Quota cannot be introduced unless additionals PG medical seats are sanctioned by the Medical Council of India.

After a plea was provided to the Supreme Court, the SC has asked the Government of Maharashtra to give their response to the plea of the implementation of the 10% EWS reservation in the medical admissions at the postgraduate level. The quota allows for candidates belonging to the economically weaker sections of the society will be provided with 10% reservations in jobs and educations across all fields of education and work.

The plea, which has been filed by Janhit Abhiyan and another individual, asks for staying the quota for the year as the necessary seats have not been added to the colleges and universities. They state that introducing the EWS 10% quota this year will take away from the seats that are meant for the General Category, thus increasing the already high competition that candidates from general category face during the admission process.

The Government of Maharashtra along with the Medical Council of India (MCI) have been asked to provide them with a reply to the petition by a Vacation Bench which consists of Chief Justice Ranjan Gogoi along with Justice Aniruddha Bose. MCI and the Government will have to provide the status of the implementation of the Reservation Quota along with their response to the plea.

As per a statement made by Advocate Nishant R Katneshwarkar, that most of the admission processes have already begun and the provision of the EWS reservation has been implemented. The seats under quota have been filled, he further added. Sources state that the implementation of the quota had already taken place in February this year as per the Centre’s orders.
