Supreme Court upholds decision to keep 6 years as minimum age criteria for Class 1 admission at Kendriya Vidyalayas

The Supreme Court has stuck to the decision to keep 6 years of age as the minimum age criteria for Class 1in the KV Admissions Procedure, quashing the petitions that were raised against the decision by several parents.

Several parents had raised petitions against the decision by KVS (Kendriya Vidyalaya Schools) to raise the minimum age criteria for children from 5 years to 6 years of age. However, the Supreme Court has stayed the decision taken by KVS, citing that they were just following the National Education Policy (NEP) 2020.

The single bench from the Supreme Court which looked into this matter sided with the KVS Authorities and stated that - “No doubt, the policy which was formulated in 2020 is yet to be implemented across schools in Delhi, despite the same having been already implemented in 21 states but once the statute i.e., the RTE Act, 2009 in itself places the KVS in a separate category coupled with the fact that all branches of KVS across the country, being run by the same management are obliged to follow the uniform criteria, the anxiousness of the KVS to introduce the age criteria of 6 years in accordance with the NEP, 2020 is well understood”. 

After the appeals against the raising of the age went dismissed by a Delhi HC bench, the matter was brought before the Supreme Court through a Special Leave Petition which was once again dismissed by the SC bench comprising Justices Kaul and MM Sundresh on April 25, 2022.
