Delhi HC Asks Union Health Ministry to Solve Complications of Reservation Under Defence Category

In July'16, 5% of reservation was introduced under defence category.

The Home Ministry of India asked for reservation in the medical courses at undergraduate level for defence category students. The Delhi High Court stepped in and requested the Union Ministry of Health and Family Welfare to check if the implementation of reservation is possible from the coming academic year. This request was made by Justice Sanjeev Sachdeva of the High Court. In the month of July 2016, 5 percent of the reservation was introduced under defence category by the officials.

This issue was taken up in the Delhi High Court by Noor Dhaliwal because he said that the Vardhman Mahavir College and Safdarjung Hospital are not following the reservation policy under defence category. These colleges come under the Guru Gobind Singh Indraprastha University (GGSIU).


The Ministry of Health told the court that with consultation from the Law Ministry and the Ministry of HRD would be required if they are to introduce the 5 percent reservation in the colleges. The Ministry also said that it cannot be applied in the current academic year as the admissions have already closed on 30th September' 16.

The High Court dismissed the plea saying that the defence category reservation only came in light in the month of July' 16 and the authorities need sufficient time to incorporate it in the current system. The court has also vacated its order directing the university to defer counselling for the 5 percent quota for defence category.
