Delhi HC to CBSE: Why Did You Do Away with Re-Evaluation?

On June 21, 2017, the Delhi HC questioned CBSE on why it scrapped the provisions for re-evaluation of CBSE Class 12 answer sheets. The High Court expressed its dissatisfaction after it was revealed that the in the Class 12 answer sheets, the correct responses to questions had been awarded zero marks. Justices A.K. Chawla and Sanjeev Sachdev directed then Central Board of Secondary Education or CBSE to give an explanation on such ‘apparent errors' in the evaluation. The court further expressed that these errors put the life and career of students in risk.

Additional Solicitor General Mr. Sanjay Jain who was representing CBSE filed a response claiming that the board had done away with the process of re-evaluation, as the number of errors in the evaluation were less or minuscule. However, the court was not convinced by the argument of CBSE, as there were various allegations raised by students with regard to the totalling of marks.

The court directed CBSE to file on record its examination committee and governing body's reasoning behind the decision that was taken in October 2016. The court posted the matter for further hearing on June 23, 2017.

The High Court also directed CBSE to give an explanation on how a student secured zero marks when the answer was correct as per the marking scheme.

CBSE also informed Delhi HC that the order of Odisha HC to re-evaluate answer sheets of 150 students was incorrect. Now, the board is planning to appeal against the order that directed re-evaluation of answer sheets. The board also informed that the High Court of Odisha will set up a special bench to hear the board's plea.
