Joint Entrance Examination (JEE) Advanced is conducted every year for admissions to the Indian Institute of Technology (IITs). The conducting body of the JEE Advanced exams, the Joint Admission Board (JAB) has declared a notification on the eligibility criteria for the JEE advanced 2022. As per the notification, JAB allowed the candidates from 2020 and 2021 to appear for JEE Advanced 2022 under certain conditions:

  • Condition 1: Candidates must have appeared for Class 12 Board exams in 2021 and 2020 and have registered themselves for JEE Advanced 2021 but did not appear for the exams.
  • Condition 2: Candidates must have appeared for Class 12 in 2020.

JEE Advanced 2020 and 2021 candidates who have appeared for the exam and could not qualify or secured low marks are not eligible for JEE Advanced 2022. Pertaining to this notification, the JEE Advanced 2020 and 2021 candidates with low scores and who did not qualify approached the Apex Court (Supreme Court of India) challenging the decision.

According to the official website, the first meeting of the Joint Admission Board on JEE Advanced 2022, conducted on December 14, 2021, was stated to offer relaxation to the candidates due to the hardships faced during the ongoing COVID-19 pandemic. The website states this is a one-time measure only. The petitioners challenged the decision of the JAB as they were ineligible for applying to the JEE Advanced 2022.

The notification nowhere mentions the candidates who have applied for the JEE Advanced 2020 and 2021 and appeared for it and received low marks or did not qualify, argued the petitioners.

On the matter, the plea (by JAB) was made referring to another case by the Supreme Court of India where the circumstances were similar. However, in this case, the circumstances do not stand similarly and respond that there is no question of unequal treatment for the petitioners. Further, the plea argued that in the current case, there is no change in circumstances for the petitioners to claim relaxation. Candidates who have appeared for the JEE Main and failed, by default failing the opportunity to appear for JEE Advanced, candidates who have qualified for the JEE Main but did not register for JEE Advanced, or the candidates who did not register for JEE Main were eligible for the relaxation, however, candidates who have appeared for both JEE Main and JEE Advanced on 2020 and 2021 and qualified were denied the chance of relaxation.
