The petitioners argued that the NEET examination was not carried out in a uniform manner all over India. They accused the Council for distributing different sets of question papers in different places of the country, although syllabus of the examination was announced same in every part of the country. And no such information about the different set of question papers was circulated.

The petitioners said that for one India, only one NEET question paper is must else the scaling of aptitude and intelligence would differ. And evaluating all the candidates on the basis of the different question paper will not be fair. Thus, they requested to cancel the previous NEET examination and conduct a fresh examination with uniform question papers all over the country.
