NEET 2017: Madras High Court Refuses Stay on Medical Quota Seats for State Board Students

The High Court of Madras clarified that it will not grant an interim stay on state government’s order of reserving 85% medical seats to state board students. Justice Pushpa Satyanarayana made this statement while hearing the plea filed by a section of CBSE students challenging the government order of Tamil Nadu issued on June 22, 2017. The petitioners claimed that granting 15% of medical seats to CBSE students in Tamil Nadu is not judicial, and demanded the government to rollback the decision.

The bench issued notices to Medical Council of India (MCI), Secretary of Selection Committee, Additional Director of Medical Education and Secretary of Family and Health Welfare Departments seeking their response on the plea. The court directed them to file their response by July 5, 2017.

The petitioners revealed that the Supreme Court has quashed allocation of medical seats based on Board of Education. The apex court has clarified that there should be no discrimination in the allocation of seats as NEET is a national level entrance examination. The states should not make discrimination between the schools affiliated to state boards and CBSE. The petitioners further claimed that they completed Class 12 in schools situated in Tamil Nadu, and they should be treated equally during the allocation of seats at par with state board students.

The court took up the matter for hearing on June 28, 2017.

According to the government of Tamil Nadu, the majority of medical aspirants from state completed Class 12 under state education board. There were only 4,220 CBSE students. Therefore, the state government decided to reserve 85% medical seats to state board students. However, the petitioners claimed that the decision taken by the state government is discriminatory.
