The Supreme Court of India has recently furnished a notice on a petition that was earlier filed by aspiring NRI candidates requesting time to register fresh in the NRI quota for the NEET Admissions 2021 Mop-up Counselling.

The bench of Justices Surya Kant and DY Chandrachud has asked the State of Kerala to inform the bench of the vacant seats following the Mop-up round of counselling.

The bench was passing a judgement on a petition turning on the order by the Kerala High Court, dated April 8, 2022, which rejected the written appeal by KPMCMA (Kerala Private Medical College Management Association) and upheld the decision of a single judge to refuse further grant time for registration.

In the challenged judgement, the bench headed by Chief Justice S. Manikumar stated –

Since the last date for admission to MBBS courses is dated April 8, 2022, the petitioners cannot be allowed extra time for fresh registration under the NRI quota, as per the directions issued by the National Medical Commission. It has been found that the candidates have been granted enough time to exercise their options. Ext. P2. list was released as early as December 21, 2021. This can only mean that there are no eligible NRI candidates available to exercise the option. Therefore, the bench is not inclined to grant the appellants any relief.

NEET Admissions 2021: Petition Challenged Order by Kerala HC

NRI aspirants seeking directions from Kerala’s Commissioner of Entrance Examinations and Admission Supervisory Committee filed the petition to allow eligible candidates some more time for fresh registration in the NRI quota before the start of the Mop-up counselling round for NEET Admissions 2021. It was pointed out that there were 618 rank holders as per the NRI list. However, 57 seats lay vacant following two rounds of counselling. The NRI aspirants contended that the various restrictions imposed during the pandemic kept several candidates from exercising their options. Under such circumstances, a plea was submitted requesting the invitation of fresh applicants to fill up vacant seats in the NRI quota prior to the NEET Admission 2021 Mop-up Counselling.
