Supreme Court Reserved Judgement on NEET EWS and OBC Quota Case
A division bench of the Hon'ble Supreme Court of India has given an interim order in an ongoing tussle between the petitioners opposing the Quota in NEET 2021 AIQ seats and the government.
The Supreme Court of India has given an interim order on NEET PG Counselling. The court observed that the implementation of EWS and OBC quota in 50% seats of AIQ in NEET PG 2021 admissions doesn't violate any rights. The MCC will be releasing the schedule for NEET UG and PG counselling soon. on the ongoing tussle between the centre and parties opposing the application of EWS and OBC quota in NEET PG counselling 2021. The hearing started on 5 January 2022 and was heard again on the evening of 6 January. The bench hearing the case was also shuffled.
On 6 Jan, a Division Bench comprising of Justice DY Chandrachud and Justice AS Bopanna heard both the parties. Senior advocate Anil Datar contended the postponing of the application of the quota for the NEET 2021 session. He also argued that the 8 LPA bar to claim the EWS quota was implemented without any empirical finding.

Solicitor General Tushar Mehta, representing the government, suggested that NEET counselling be continued. Senior Advocate Shyam Divan argued that there should be no reservation in PG admissions and these admissions should be done solely based on merit.

Earlier, the government introduced a 10% reservation in NEET counselling under the AIQ seats. For PG courses, 50% of the total seats are filled by AIQ while only 15% seats are filled in UG. The criteria to claim the EWS quota was also changed by the centre last year to set the bar for income at 8 LPA to claim the EWS quota. However, a committee constituted by the government in this regard suggested the earlier bar of Rs 5LPA as income is reasonable and 8 LPA bar should not be implemented for NEET 2021 admissions.
