AICTE to Approach SC to Seek Clarification About Recent MBA Order

The Supreme Court has recently passed an order regarding management courses and colleges, segregating them from technical education and therefore, from the AICTE. In this context, the AICTE is to approach the SC soon to get clarification on the issue.

The AICTE (All India Council for Technical Education) is likely to reach out to the Supreme Court in the month of September in order to seek clarification over the order it had passed on 24th July 2019. The apex court had ruled on 24th July that MBA (Masters in Business Administration) is not a part of the technical education sector and any institute or college that is affiliated to a university can introduce an MBA programme with no prior approval from the AICTE.

It has been learnt that the AICTE has already consulted the Solicitor General of India and following his advise, the council will most probably approach the Supreme Court to get clarity on this rule that the court had passed in July. There are over 450 PGDM (Post Graduate Diploma in Management) institutions in India that have enrolled more than 1.5 lakh students, which are going to be affected by this order directly as they are not affiliated to any university.

It has been said that the AICTE will not file the review petition against the order. Rather, it will go forward seeking clarification so as to understand the consequences of this order by the SC. The court is like to reject the review petition. The Chairman of AICTE, Professor Anil Sahasrabudhe, has said that if the order given by the SC is not in the interest of the general public then either the AICTE or the MHRD (the Ministry of Human Resource Development) will approach the apex court once again by filing a review petition.

The Supreme Court will be approached by the AICTE in the next month. A delegation of the PGDM institutions had a meeting with the AICTE after several kinds of misinformation had done rounds on social media. The delegation apprised the council about their concerns and apprehensions regarding the recent verdict of the SC.

The Chairmen, Deans, and Directors of these PGDM institutions requested the AICTE to go forward with suitable legal actions so as to provide some clarity on this confusion and restore the fifty years old control and regulatory supervision of the AICTE with respect to management education.
