PIL Lodged at MP HC Challenging the Absence of EWS Quota in Private Medical Colleges

A notice has been issued by the Madhya Pradesh High Court to the state government of MP and for Private Medical Colleges in the state. As per the PIL challenging non-implementation of the 10% EWS quota in Medical Courses ofMBBSandBDS. The Public Interest Litigation filed by a journalist named Rahul Kumar Mishra was heard in the division bench of Acting Chief Justice R S Jha and Justice V K Shukla.

The lawyer of the petitioner, Mr. Brahmanand Pandey has said that the court has sought responses from the government and other concerned respondents within 4 weeks regarding the matter. He added that the state has already implemented 10% EWS seat reservation in the government medical colleges of the state where admissions are still underway on the basis ofNEET Examinationbut there has been no allocation of EWS Seats in the private medical and dental colleges.

According to the lawyer, the petitioner had to move to the court as there was no response from the director of medical education, Madhya Pradesh despite taking the matter to their concerns again and again.

Advocate Pandey added that the General Administration Department of Madhya Pradesh Government had issued a circular on 2nd July 2019, directing to implement 10% EWS Reservations in all educational institutions except the minority-run ones. Other respondents in the PIL include the Central government, Medical Council of India (MCI), the Director of MP Medical Education, and all private-run medical and dental colleges.
