State Govt. Not Allowed to Review Recognition to AICTE Approved Institutes: Kerala HC

  • The state government of Kerala challenged AICTE recognition to two new polytechnic colleges in Kerala HC. The court dismissed the course stating that the state government could not challenge the recognition granted by AICTE.

The state government of Kerala has lost its case against the two private polytechnic colleges that were granted recognition by All India Council for Technical Education (AICTE). The High Court of Kerala dismissed the reasons cited by the state government to exclude two new polytechnic colleges from the centralized seat allotment.

On July 10, 2018, the High Court of Kerala directed the state government to include two new polytechnic colleges located in Thrissur and Ernakulam in the centralized seat allotment process for the academic session 2018-19. However, the state government had challenged the AICTE approval of these colleges stating that the colleges did not comply with the norms that are necessary to grant approval by the government. Further, the court directed the state government to submit a report on deficiencies spotted in these colleges.

As per the report, the state government submitted to the court that the newly approved polytechnic colleges by AICTE do not have proper infrastructure and conditions to admit students. However, the court trashed the reasons mentioned the state government. The court confirmed that the approval granted by AICTE is final. As per the AICTE report, there were no deficiencies in these colleges in terms of infrastructure and other facilities. Therefore, the state government has no authority to review the recognition granted by AICTE, clarified by the court.

As per the latest decision the court, the state government of Kerala will have to include two new polytechnic colleges in the centralized seat allotment process.
