One of the school students approached Delhi High Court alleging the faulty evaluation of her CBSC Class 12 Economics answer sheet. Justice C. Hari Shankar has not issued any direction to Central Board of Secondary Education in this regard. The CBSE discontinued the practice of re-evaluation of answer sheets this year. The Judge specified that he has no authority to pass an order since there is no specific challenge to CBSE’s notification that was issued in October 2016. The notification issued by CBSE in October 2016 ordered the discontinuation the practice of re-evaluation of answer sheets.
Giving clarification, the court mentioned that it could not grant any relief to the student. However, the counsel for the girl pointed that the High Court of Orissa had directed the CBSE to re-evaluate the answer sheets of 18 students. These students filed the plea in Orissa HC alleging the faulty evaluation.
Considering the argument, the Judge directed the counsel for CBSE to secure a copy of Orissa HC order and submit it before Delhi High Court by June 15, 2017.
The court also sought clarity from the counsel of both parties whether there was a disclaimer on the official website of CBSE stating that the photocopy of evaluated answer sheet shall not be challenged by any student in the court of law or make any claim on this regard.
The girl approached HC seeking re-evaluation and photocopy of her Class 12 Economics answer sheet. However, the counsel of CBSE had opposed it, as the board discontinued the re-evaluation of answer sheets.
