The Medical Council of India, Aligarh Muslim University and Banaras Hindu University joined hands to challenge in Supreme Court (SC) on Allahabad High Court order that set aside 50% institutional preference in admission to Postgraduate (PG) medical seats. In this regard, the vacation bench of justices Deepak Gupta and Ashok Bhushan reserved the verdict to June 7, 2017, after hearing the arguments.

During the brief argument session, both the universities indicated that the order of Allahabad HC violated the judgment of the apex court and MCI regulations that allowed institutions to take 50% admissions from their own institution. Both BHU and AMU got the support from Medical Council of India (MCI) on the issue. They argued that Allahabad HC unnecessarily interrupted with the laid down rules and regulations. Mr. Maninder Singh, Additional Solicitor General representing BHU, sought an immediate stay on the Allahabad HC order (May 29, 2017). According to him, it is not possible to change or revise the entire rules.

Mr. Maninder Singh also indicated that it is not possible to re-open 50% of PG medical seats for the students selected through NEET-PG. According to the earlier verdict given by the Supreme Court, only 50% of PG medical seats come under All-India quota, and the rest come under institutional quota or preference.
Salman Khurshid, a senior advocate representing Aligarh Muslim University (AMU) revealed that the institute had already filled some seats through 50% institutional preference. Therefore, the court must impose a stay on the order of Allahabad HC.
