Supreme Court Decision on Cancellation of Offline Board Exams 2022

In its hearing on the plea seeking cancellation of offline board exams 2022, the Supreme Court noted that such petitions should not be encouraged and further it dismissed the plea.

Supreme Court of India took up its hearing on the petition session cancellation of board exams 2022. The court dismissed the plea indicating that any decision regarding the exams shall be taken up by the respective exam authority and warned not to file such ill-advised pleas further. CBSE Term 2 Exams 2022 will be conducted as scheduled which will commence from April 26, 2022. 

Highlights of SC Hearing on Plea Seeking Cancellation of Offline Board Exams 2022

Here are some of the major highlights of the Supreme Court decision on the cancellation of offline board exams -

  • The court remarked that the decision whether to conduct the exams or not shall be taken by the authority
  • The court further noted that the PIL filed is completely ill-advised and premature. Most of the boards ate yet to take a decision on exams. If the decision taken by boards is not as per rules and regulations then it has to be challenged
  • These Petitions just created false confusion among students and they should not be encouraged
  • The court warned that such ill-advised petitions should not be filed for the sake of publicity and the court will impose exemplary costs

During the hearing, the Bench dismissed the petition calling it Ill-advised, premature, and creating false hope and confusion. The bench has also warned the petitioner to not come up with such a plea again as it can cause exemplary costs. The court has stated that it is the responsibility of the boards to schedule the exams and it should not be interfered with.

On February 21, 2022, a plea was submitted in Supreme Court by Anubha Shrivastava Sahai regarding the demand of CBSE Board Exams Cancelling & alternate assessment. The plea was listed in Supreme Court under urgent matter which was designated to be taken under Justice A.M. Khanwilkar's bench. Though the plea was submitted for all the board exams, Supreme Court only undertook the CBSE Board Exams in consideration.

There is no possibility of cancelling the CBSE Term 2 Board Exams 2022 as the board has already divided the syllabus into two different terms, Term 1 and Term 2 exams. Meanwhile, the Term 1 exams are already conducted and Term 2 dates are also out. Also, many state boards have already started their board exams with Bihar board exams being over already. Now, the students have to start preparing for their upcoming board exams as they have plenty of time left for preparation.
