Students from Open Schools can Enroll as Lawyers: Madras HC

  • The High Court of Madras confirmed that the candidates who obtained Bachelor’s degree in regular mode from a recognised university could be considered for the admission to three-year LLB course and are eligible as Lawyers.

The High Court of Madras has clarified that law graduates can enrol as graduates even though they cleared Class 10 and Class 12 privately or through open school mode. The bench comprising of Chief Justice Indira Banerjee, Justice Abdhul Quddhose and Justice R Subbaiah passed orders on a batch of petitions on July 23, 2018.

As per Bar Council of India, candidates who passed Class 10 and Class 12 in regular mode are eligible for the admission to three-year law course. However, the High Court of Madras confirmed that the candidates who obtained Bachelor’s degree in regular mode from a recognised university could be considered for the admission to three-year LLB course.

On the other hand, the High Court of Madras indicated that the candidates who obtained a graduate degree or Bachelor’s degree from an open university without Class 10 & Class 12 basic qualification are not eligible for the admission to three-year LLB course.

The petitions were filed by a section of students whose applications for the enrolment as lawyers/ advocates were withheld by Bar Council of Tamil Nadu and Puducherry. The Bar Council withheld their applications citing the reasons that they had completed their schooling privately. However, these students completed a law degree under a university/ institute recognised by Bar Council of India (BCI). Therefore, they move to Madras HC seeking justice.
