Gujarat High Court Validates Domicile Rule for MBBS Admissions

On June 25, 2018, the High Court of Gujarat has validated/ approved the state government’s rule regarding domicile certificate for getting admission to MBBS course in Gujarat. As per the rule, the candidates seeking admission to MBBS admission under state quota in Gujarat must have studied and passed Class 10 and Class 12 from the state.

Chief Justice R Subhash Reddy gave clarification in this regard and rejected the petitions filed by a section of students challenging the rules amended by the state government of Gujarat.

However, the High Court of Gujarat has asked the state government to grant admission to those candidates who belong to Gujarat domicile but had passed Class 10 from other states. It is up to the state to whether or not consider the criteria of passing Class 10 from Gujarat to be continued or not. The state government shall take a decision in this regard as early as possible, informed the court.

In an affidavit submitted by the Gujarat government to HC, it clearly explained that the criteria of passing Class 10 in Gujarat was not in existence during 2015-16 and 2016-17. During these two academic sessions, students who had passed Class 12 from Gujarat were considered for admission irrespective of their domicile in Class 10. It was found that a large number of students from other states pursued Class 12 in Gujarat with an aim to get a seat in the MBBS course in the state thereafter.

After the completion of MBBS course, it is expected that the students will go back to their respective states instead of serving in Gujarat. Therefore, the state government wants to consider only Gujarat domicile students who have completed both Class 10 and Class 12 in the state. The state government had amended the law in 2017 as well, clarified the state government.
