Case: Hussainara Khatoon and others versus Home Secretary, State of Bihar Petitioner: Hussainara Khatoon and others Respondent: Home Secretary, State of Bihar An article was published in the Indian Express newspaper in 1979 about the wrongful detention of under-trial prisoners in Bihar jail, including women and children awaiting trial for years. On reading this, Advocate Pushpa Hingorani filed a writ petition under Article 32 of the Indian Constitution on behalf of these under-trial prisoners. The petition stated that under-trial prisoners who had committed petty offenses were suffering in jail for more than five to ten years without trial.

(i) Name and briefly explain the writ used by Advocate Pushpa Hingorani under Article 32 of the Constitution of India. (Understanding)

(ii) What does Article 21 of the Indian Constitution state? Briefly discuss the relevance of this Article in the context of the above case.

Q7. (i) Discuss the validity of a contract with a minor as per the Indian Contract Act, 1872. (Understanding)

(ii) Compare the Traditional Litigation System and Alternative Dispute Resolution (ADR) on the basis of flexibility and the time required to resolve disputes.

Q8. Rani owns a banquet hall in a building and gives it on rent for hosting parties and functions. Since it gets difficult for her staff to maintain the hygiene and cleanliness of the hall, Rani decides to hire another hall. Ramesh owns another large hall in the same building. Rani hires the hall on rent for five years from Ramesh. Identify and explain the transfer between Rani and Ramesh.

Q9. Jiny and Johny are partners in a partnership firm. They make an agreement in writing to refer a dispute between them in business to an arbitrator. Despite this agreement, Jini files a suit against Johny relating to the dispute in a court.

(i) Will Jini succeed in filing a suit in court? Give a reason for your answer.

(ii) What does "arbitral award" mean? Give any two points on its significance.

(iii) Give any two differences between an arbitral award and the judgement.

Q10. Explain the concept of voidability of agreements without free consent as stipulated in Section 19 of the Indian Contract Act, 1872 by citing any two examples.
