The High Court of Himachal Pradesh has dismissed the petition filed by Maharshi Markendeshwar Medical College and Hospital, Solan. Earlier, the management of the college filed a petition regarding striking down of amendments that are made to Regulation of Admission and Fixation of Fee Act 2006.

Justice Tarlok Singh Chauhan and Justice Mansoor Ahmad Mir delivered the judgement which comprised of 42 pages. The judgement indicated that the Medical Council of India (MCI) plays a significant role in granting recognition to the medical colleges while the state government is responsible for granting affiliation to the college. Hence, the central government and MCI is not allowed to dictate the terms to the state government regarding the term ‘affiliation’.
The judgement finally revealed that the petition filed by the authorities of the medical college carry no merit and hence it is being dismissed along with all the applications leaving the parties to bear expenses at their cost.

Earlier, Maharshi Markendeshwar Medical College and Hospital, Solan denied admission to 150 students and demanded fee hike. Himachal Pradesh University had already completed the counselling process, and the candidates were allotted seats. At that juncture, the medical college, without any notice, denied the admission of 150 candidates.
The government mentioned that it was not possible to change the fee structure a the admission process was completed and directed the college to complete the admission process. Therefore, the authorities of the medical college approached High Court seeking cancellation of amendments regarding fee fixation.
